Tony Abbott says the latest High Court ruling on asylum seekers is another complication for a government that is mishandling its border protection policy.

Tony Abbott says the latest High Court ruling on asylum seekers is another complication for a government that is mishandling its border protection policy.

The opposition leader's comments come after the High Court ruled on Friday that an asylum seeker deemed a security risk can still be granted a refugee visa.

In the decision, a majority of High Court judges overturned a regulation that specifies that an asylum seeker deemed a security risk by the Australian Security Intelligence Organisation (ASIO) can't be granted a protection visa.

The decision has important implications for some 50 mostly Sri Lankans given adverse ASIO security assessments who are in indefinite detention in Australia.

Mr Abbott said stopping the boats was the best way to avoid the problem the High Court pointed to.

"It's yet another complication for a government that has comprehensively mishandled border protection policy," he told reporters in Sydney on Saturday morning.

He reaffirmed his calls for the government to reinstate the coalition's full suite of border protection measures including temporary protection visas.

The vast majority of asylum seekers come by plane. The High Court ruling is equally relevant to those people. Tony Abbott is either ignorant, or playing cynical politics by suggesting that stopping the boats is the way to solve the problem.

cant we just deport abbott and bernadi and jones lets send them to naura it will save the taxpayer some money.We could use the money to invite in some more kind caring educated and compassionate people to replace them and that way we all win.Well except the racist right wing nut jobs who support these intellectual giants.

Why don't we hand over government of this country to the high court??? It appears we can't do anything in this country without asking the high court, so just cut out the middle man ie the government. I can understand why the legal fraternity rates lower than used car salesmen in the piblics opinion. We didn't vote for the people on the high court bench, so they should stay out of the government decision making. After all they are only in it for the money.
