A woman who alleges she was raped by former ATSIC chairman Geoff Clark has been granted special leave by the High Court to proceed with her civil case.

Carol Stingel issued a writ in 2002 in which she alleged she had been raped by Mr Clark in 1971.

She claimed that she had suffered various psychological symptoms over the years resulting in post traumatic disorder in about 1999 or 2000.

A full bench of the High Court has granted her special leave to allow a hearing into her claim.

Outside the court, her lawyer Dr Viv Waller said her client was relieved and happy with the outcome.

Dr Waller said the decision would allow the case to be examined in Canberra by the High Court.

It is the latest chapter in a long-running legal battle.

In May, the Victorian Court of Appeal had ruled that the Statute of Limitations did not permit civil proceedings to be brought against Mr Clark.

It ruled the delays in the proceedings had caused so much prejudice to Mr Clark that he would not receive a fair trial.
