Aboriginal protesters, who set up a camp in a central Melbourne park are taking legal action against an order to leave.

The Melbourne City Council has ordered the protesters to go by 4 pm, Melbourne time, and have told them they will be forcibly removed from the gardens soon after that if they do not go willingly.

Aboriginal camp spokesman, Robbie Thorpe, says the group's lawyers will be seeking an injunction against the order, and will hold a peak hour protest today if authorities force the camp to disband.

Angry by the absence of the Aboriginal flag at the Commonwealth Games, Mr Thorpe is asking Victoria's Premier, Steve Bracks, to do more for the Aboriginal people.

"We're asking where the bloody hell is Bracks in regards to the Indigenous people in Victoria."

"The Indigenous people in Victoria have got no native title, we own 0.01 per cent of the land here."

"We've gone backwards since our reservation days."

"We've got nothing to look forward to in terms of this Labor government, despite them having all the power in both houses, still nothing."
