The British government is set to appeal against a court decision entitling Australian detainee at Guantanamo Bay, David Hicks to a UK passport.

David Hicks is hopeful British Citizenship will help him achieve a release from the maximum security detention centre.

His lawyer, David McLeod says even if David Hicks is successful in gaining a UK passport, the British Government could withdraw it immediately.

But Mr McLeod says this latest appeal is just the next step in a long battle.

“He's used to some setbacks and we expected the UK government would seek to appeal, they have appealed and we've just got to deal with it.” Mr McLeod said.

David Hicks has been held at Guantanamo Bay for the past four years.
