The Commonwealth Ombudsman has recommended that that the Immigration Minister consider granting a humanitarian visa to an asylum seeker who witnessed the Tiananmen Square massacre.

Professor John Mcmillan has made recommendations in relation to five asylum seekers whose cases were referred by Senator Amanda Vanstone because they may have been wrongfully detained.

The cases are among about 200 the Minister referred to the Ombudsman for investigation.

The Ombudsman says the condition of the Chinese asylum seeker has worsened during his two and a half years at Villawood Detention Centre.

The detainee is also concerned that a visit to Villawood from a Chinese consular official may have exposed him to persecution if he's returned.
