The Wheat Board says it should not have to hand over documents, prepared on the advice of a public relations consultant.

It says the documents, compiled in the course of an internal inquiry into alleged kickbacks, should be protected by legal privilege because they were prepared in order to get legal advice.

The Cole inquiry has been adjourned pending the outcome of AWB's challenge.
