A lawyer for Australian terrorism suspect, David Hicks, has failed to secure a major change in the federal government's position on his client, after meeting with Foreign Minister, Alexander Downer.

Adelaide lawyer David McLeod sought a meeting with Mr Downer, after the United States Supreme Court ruled recently that the American military commission process set up to try Mr Hicks was unconstitutional.

Mr McLeod says the federal government should secure Mr Hicks' release from the American military base at Guantanamo Bay where he is being held.
