David Dungay's grieving mother and family attended Glebe Coroner's court for the directional hearing into his death with a date of july 16, 2018 set for a coronial inquest.
Mr Dungay, 26, died while in Long Bay prison serving an 8 year sentence for home invasion and sexual assault.
His death occurred after being restrained and tranquilised by riot officers despite telling them he couldn't breathe.
At the time he was receiving treatment for type 2 diabetes and schizophrenia.
A health report says that Mr Dungay had argued with the prison guards and refused a demand to stop eating biscuits. He was then taken to a room with CCTV and the footage shows David was held down by prison guards and injected with the drug medazolam.
NSW Corrective Services maintain the death is not being treated as suspicious. David's mother Leetona Dungay claims there's been a cover up.
She told NITV News she wants to know what happened to her son.
"I'd like those people who put my son in a black bag be accountable Why and who done it? And I'd like them to come forward and be honest, no cover up, come forward for your guilt in what you done."
