这次争议扩大到无党派参议员辛奇 (Derryn Hinch) 身上,他在新西兰出世,曾在上世纪 60 至 70年代在美国居住及担任记者。

现在备受关注的并非他在新西兰出生,而是他持有有效的美国社会保障卡,具备资格领取美国福利,这让他有可能触犯宪法第 44 条。

澳洲宪法第 44 条规订,若公民拥有另一国家的公民权利或领取福利资格,不得担任国会议员。

辛奇表示他考虑将自己提报到最高法院,由高院就自己的公民身份作出裁决。

他在接受天空访问时表示,不认为自己违反宪法,强调他并没有向美国缴交社会保障税,因此不具备资格领取福利。

“我不认为我触犯了这一规定,该规定提到: 你是否有权享有公民的权利和特权。"我无权享有权利和特权,因为我什么也没做。如果你在美国缴纳了10年的社会保障税,那么你才有资格领取养老金。”

72 岁的辛奇是澳洲历史上年龄最高的国会议员,主张严惩暴力犯和性罪犯,并认为所有公民不论其种族、肤色、信仰和性观点,应人人平等,他同时支持安乐死合法化。
