Taiwan court rules in favour of gay marriage

Supporters of same-sex marriage in Taiwan are celebrating a landmark ruling which paves the way for the island nation to become the first country in Asia to recognise gay marriage.

5月24日,台湾大法官公布同性婚姻释宪案,宣告台湾现行《民法》婚姻规定“"不允许同性结婚”的规定,违反《宪法》保障的婚姻自由与平等权。大法官要求相关机关应于2年内修正相关法律保障同志婚姻。这等于宣告台湾将成为亚洲第一个同性婚姻合法化的社会。

据台湾“中央社”消息,“同志运动”先驱祁家威因2013年与伴侣登记结婚遭驳回,认定“民法”亲属篇第二章婚姻规定“同性别二人间不能成立法律上婚姻关系”有“违宪”疑义,于是提出“释宪”申请;台北市政府民政局也针对相关婚姻法令是否有“违宪”之虞,提出“释宪”。

立法院秘书长吕太郎昨日表示,两种形式的婚姻都没有任何理由不能共存。

台湾总统蔡英文透过脸书表示,释宪结果不是胜负输赢。她还转贴了总统府对释宪结果的立场:

第一,法律必须保障所有人民的婚姻自由与平等权。依据宪政体制,大法官所作出的解释文,有拘束全国人民及各级机关的效力。

第二,行政部门会依照今天的释宪结果,并综合各界的意见,尽速提出具体的法律方案,送交立法院审议;务必要如期完成三读。

第三,我们呼吁整个社会,以理解,包容,尊重的态度,来面对跟自己意见不一样的人。我们相信,台湾有成熟的民主机制来化解歧见。
