A tribunal is set to consider whether a decision by the Department of Home Affairs to refuse a visa to a three-year-old boy with disabilities would place his life at risk.

At the request of the boy’s family, the Administrative Appeals Tribunal will hold a hearing in Perth on Thursday to review the department’s refusal of a temporary visa to Kayban Jamshaad.

Kayban was born in a Western Australian hospital in July 2016, and diagnosed with severe haemophilia and an acquired brain injury caused during delivery.

At the hearing,  his mother Ms Aishath will have up to three hours to give evidence and present arguments to show that her son’s condition would deteriorate if he were deported from Australia.
