From Wednesday, Indians in Australian jails can choose to transfer to Indian prisons

Several Indians are serving their jail term in Australia.

32-year-old Manisha Patel, originally from Gujarat, is serving jail time in Australia for brutally murdering her boyfriend's new fiancee in a jealous rage in 2013.

31-year-old Nitin Rana, a taxi driver is jailed for six years in Australia for raping a drunk and vulnerable 17-year-old schoolgirl.

Similarly, Simardeep Singh, a taxi driver in Perth who fled to India a day after he raped a female passenger and indecently assaulted another in Perth, too is serving his sentence of five-and-a-half years in Australia.

An Indian diplomat’s son, Navin Edwin is serving his 10-year jail term for a series of sexual offences against three young girls.

Now, a new prisoner transfer deal between Australia and India means these convicts can apply to serve the remaining part of their sentences in India.

The prisoner transfer deal signed between Australia and India which comes into effect on Wednesday, 21st December 2016, allows prisoners to continue serving their remaining term in their home country.

The agreement, signed in 2014, will enable Australians in Indian jails to apply to serve the remaining part of their sentences in Australia, and Indian prisoners in Australia to serve their remaining part of the sentences in India.

If an Indian prisoner wants to be transferred to India, the Ministry of External Affairs, India suggests they should notify the Indian embassy or consulate of his or her desire.

The application then must be approved by Australian Government and the Government of India. For the prisoner to serve the rest of his/her sentence in India, there must not be a standing appeal against his committal to prison in the foreign country.
