Customer awarded $1200 after Dominos fails to deliver his pizza

A lawyer in Sydney took Dominos to court after his pizza order never arrived.

Sydney lawyer Tim Driscoll ordered three pizzas and some extras online from Dominos last year on Anzac Day. He paid the total bill of $37.35 online but his order never arrived, Herald Sun wrote.

When he called the store, the store’s manager apologised and said they were ‘inundated’ with orders on that day and that his money would be refunded.

Mr Driscoll, a lawyer is Sydney specialises in personal injury and workers compensation cases. After Dominos failed to refund his money, he sued them for a breach of contract citing they failed in their contract to deliver the pizzas.

According to Herald Sun, Domino’s was ordered to pay him $1203.27 over the $37.35 order yesterday.

Mr. Driscoll initially claimed $9000 damages “to teach them a lesson” but was happy with the court judgment which covered his legal fees and the cost of the pizza order.

But yesterday in court, Mr Driscoll accused Dominos of disrespecting the consumer and the judicial system after Domino’s did not attend court and failed to acknowledge the judgement.

He admits his step was extreme but explained that he took this step only after being “fobbed off” by them for over a year.

“They kept saying they were looking into it but after 12 months of fobbing me off with ‘we’ll get back to you’, I thought I had to bring it to a head,” he said.

“I took the extreme step of going to court.”
