A Sydney taxi driver convicted over a fatal hit-and-run has avoided prison time after being sentenced to an 18-month intensive corrections order.

Amarjot Singh Randhawa was found guilty in October 2015 of dangerous driving occasioning the death of Andrew Francis Heffernan after driving off while the 23-year-old was on top of his taxi in the early hours of May 26, 2012.

Mr Heffernan fell from the vehicle and died as a result of his injuries.

At Sydney District Court on Thursday, Judge Gregory Farmer said Randhawa had been remorseful despite pleading not guilty.

The court heard Randhawa's decision to drive off while Mr Heffernan was aboard the car was a case of "momentary misjudgment".

Judge Farmer permitted Randhawa to serve out his 18-month term via an intensive corrections order, under which jail time is served in the community with supervision and conditions.
