Kulbhushan Jadhav Case: India and Pakistan to face off in International Court of Justice

The International Court of Justice stayed the hanging of Indian national Kulbhushan Jadhav, who was sentenced to death by a Pakistani military court on charges of spying.

India and Pakistan will face each other at the International Court of Justice in The Hague today over Indian national Kulbhushan Jadhav's death sentence by a Pakistani military court, NDTV reports.

The Indian government filed a lawsuit in the world court challenging the findings of a Pakistani military court – which accused and convicted Jadhav of terrorism and spying.

Indian government argued that despite an international treaty – the Vienna convention on Consular Relations – there was an “egregious violation” of it by Pakistan. According to the treaty, any person arrested or detained in a foreign country has the right to have their embassy notified of the same. However, in Jadhav’s case no consular access was given.

Jadhav's execution in Pakistan was stayed by the ICJ, following the filing of this lawsuit.

The Netherlands-based ICJ will likely take up Jadhav’s case at around 5.30pm AEST in the Great Hall of Justice housed in the Peace Palace in the city of The Hague.

Senior Indian lawyer Harish Salve is representing India, India's Minister of External Affairs, Sushma Swaraj tweeted.

India says Jadhav, a former naval officer, is innocent. He was kidnapped and framed by Pakistan in total disregard of international laws. While Pakistan says the 46-year-old is a spy involved in terrorism and deserves capital punishment.
