Federal Labor has called for the expulsion from the party of the Victorian Secretary of CFMMEU, John Setka. But the union leader has broken his silence, saying he won't resign.

John Setka has long been a welcomed member by the Labor Party, attending the ALP Conference last year in Adelaide, addressing delegates and rubbing shoulders with senior members of the Labor Party.

But the new leader of the federal Labor party, Anthony Albanese, says he's taking action to severe Mr Setka's ties with the party.

That decision follows comments Mr Setka reportedly made at a union meeting about Rosie Batty.

Ms Batty has been a prolific anti-violence campaigner since her 11 year-old son Luke was killed by his father.

Mr Setka reportedly claimed her advocacy has led to men having fewer rights.

Mr Setka said the claims made about him are an outright lie and an exaggeration and he would not be stepping down over innuendo and lies.
