Last week, the Korean program reported that the Fair Work Ombudsman has launched a legal action against the operator of Sushi Bay ACT Pty Ltd for allegedly exploiting mainly Korean workers in Canberra. The news provides a huge shock to Korean communities because the Sushi operator has a few outlets in NSW, QLD and Northern Territory and the restaurants were pretty familiar to locals.
In a week time after the news, the Fair Work Ombudsman announced that they are taking a legal action against another company in Melbourne exploited three Korean workers. This time, it is a contract cleaning service operator based in Melbourne.
David Leslie Hinchliffe and his company Davdot Pty Ltd, which trades as Davdot Facility Services allegedly, underpaid three casual cleaning employees, mainly Korean workers, a total of $10,428 between October 2015 and August 2016.
The workers were allegedly underpaid various entitlements including minimum rates for ordinary hours, casual loadings, overtime, minimum engagement pay and penalty rates for weekend and public holiday work.
Fair Work Ombudsman Natalie James said employer ignored Ombudsman's warning that failure to rectify issues within their operations would lead to court and the potential for heavy financial penalties.
A directions hearing of the case in the Federal Circuit Court is scheduled in Melbourne on December 19.
