In this episode we discuss dispute resolution and settlement agreements, looking at the pros and cons of litigation. We also look at the different steps one should initiate before seeking legal action.
In this episode, Matthew Karakoulakis cautions that litigation should be viewed as a last resort and should only be started when all other avenues have been exhausted.
“The best outcome is for parties to resolve their disputes without going through a legal process.”
Going to court can be a very effective process however, it can also be very stressful, time consuming and expensive.
“Thankfully, Australia has one of the best legal systems in the world.”
Matthew Karakoulakis also explained that because of the adversarial nature of our legal system, a seemingly simple case can easily become drawn-out, costly and very stressful.
He added that one can never tell how much a litigation might cost in advance as things could spiral out of control resulting in unpredictably high costs for the parties involved.
