High Court decision sends federal politicians packing

The High Court has ruled Barnaby Joyce and four other federal politicians embroiled in the dual citizenship saga ineligible for parliament. Two others were cleared.

Five politicians including the former Deputy Prime Minister Barnaby Joyce have been ineligible from sitting in parliament, following a High Court decision on their dual nationality.

Deputy Prime Minister Barnaby Joyce, Senator Fiona Nash, former Greens senators Scott Ludlam and Larissa Waters and One Nation senator Malcolm Roberts were all deemed "a subject or a citizen ... of a foreign power" at the time of their nomination for the 2016 federal election.

Nationals senator Matthew Canavan, who stood down from cabinet, and independent Nick Xenophon were not disqualified from nomination for the election. Senator Canavan will resume his old job as Minister for Resources and Northern Australia.

The vacant Senate seats will be filled by a special count of ballot papers from the 2016 election.

Whilst Mr Joyce will now face a by-election in his seat of New England on December 2.
