Independent M-P Kerryn Phelps says she wouldn't have nominated Peter Dutton for a high court referral over his eligibility to sit in the parliament if she wasn't sure.
Home Affairs Minister Peter Dutton has been alleged to benefit from his family trust, which owns two childcare centres in Queensland.
The Coalition government denies the allegations.
Liberal leader Christopher Pyne last week threatened to retaliate against Dr Phelps if the parliament decides to refer Mr Dutton to the High Court.
Ms Phelps has been questioned by the media over her occupation as a GP and a City of Sydney councillor.
Ms Phelps has told the A-B-C, she would have nominated herself if there was a serious question over her eligibility in the parliament
