The new regulations will replace the Education Services for Overseas Students Regulations 2001 which ceases on 1 October 2019.
According to the explanatory statement of the federal legislation, “A small number of additional provisions have been inserted into the Regulations to give effect to the implementation of the revised National Code and the commencement of the Education Legislation Amendment (Provider Integrity and Other Measures) Act 2017.”

“These additions to the Regulations include prescribing certain information that must be reported for the registration of providers and additional information that registered providers must provide about accepted students, including details of education agents who facilitated or are facilitating the student’s enrolment with a provider,” the statement reads.
What is changing?
Most of the EOS regulations are same as the current regulations; however now the providers must:
- Give information on education agents for every student enrolment where an agent of the provider facilitated the student’s acceptance for admission.
- Give more information on students’ English language proficiency concerning student visas. It includes the date a student took an English language test.
- Give further prescribed information about students who have breached a condition of a student visa. For instance, if the student does not begin his or her course when expected, the provider must give the student’s current residential address, phone number and email address.

The Department of Education has clarified that anything done according to the old regulations will continue to have effect after the commencement of new rules.
