Indian Court demands ‘wife beater’ NRI be brought back home from Australia

He left for Australia to renew his PR visa and did not return.

Gujarat High Court has directed Gujarat Government to inform Indian and Australian embassies to ensure that Australian PR visa holder, Pratik Pathak is brought back to India, as per a report in The Times of India.

Pratik Pathak, former resident of Vadodara, was arrested in 2011 after his wife, Bhumika lodged a complaint against him at local police station for allegedly beating her up, making dowry demands and issuing threats to her.

In 2012, Pathak moved the high court for quashing of the FIR, following which the High Court stayed the investigation.

In 2013, Pathak, an Australian PR visa holder, approached the lower court for release of his passport, so that he could visit Australia to get his visa renewed. His passport was released for three months after he paid a bond of Rs 50,000 to the lower court.  

Pathak left for Australia but did not return.
In August 2015, his wife, Bhumika moved the Gujarat high court complaining against the lower court’s decision to allow her husband to travel to Australia.

She urged the high court to bring her husband back to Gujarat to face trial for domestic violence, dowry demands and threatening her.

Following her application, Gujarat high court on last Thursday, directed Gujarat government to inform the embassies of India and Australia that the person is wanted for trial and violation of his bail conditions.

The high court also ordered that the passport office be enjoined as party to further proceedings.

Next hearing is scheduled on July 29th.
