An engineering student who was mistakenly given $4.6 million by a bank, may not have broken the law, a magistrate said.

Christine Jiaxin Lee had opened an account with Westpac bank in August 2012. That's when the bank inadvertently gave her unlimited overdraft.

The 21-year-old Sydney woman allegedly overdrew $4,653,333.02 between July 2014 and April 2015 and spending most of it on handbags and luxury items.

Her Legal Aid lawyer told the court about $1 million had been spent on handbags, luxury items and some transfers.

About $3.3 million remains outstanding.

Ms. Lee was arrested on Wednesday while trying to board a flight to Malaysia.

While granting her bail on Thursday, magistrate Lisa Stapleton said it appeared Westpac inadvertently gave her an unlimited overdraw facility and so she used it.

"It isn't proceeds of crime. It's money we all dream of," she said.

Ms. Lee has strict bail conditions, including reporting to Ryde police twice daily, surrendering her emergency passport and living with her boyfriend, Vincent King, in Rhodes.

Though an investigation has been on in the case since 2012, an arrest warrant was issued in March this year.
