An order passed by the Judge of the Meghalaya High Court in India after the hearing of an ordinary petition relating to a refusal of a Domicile Certificate to an Army recruit, Amon Rana is now trending on social media.
In a written order, Justice Sudip Ranjan Sen linked the matter to partition in 1947.
“Pakistan declared themselves as an Islamic country and India since was divided on the basis of religion, should have also been declared as a Hindu country, but it remained a secular country,” Justice Sen wrote in an order dated December 10th.
He added: “Nobody should try to make India as another Islamic country, otherwise it will be a doomsday for India. I am confident that only this government under Shri Narendra Modiji will understand the gravity and will do the needful as requested above and our chief minister Mamataji will support the national interest in all respect.”
Justice Sen urged the Indian government to enact a legislation to allow non-Muslims from Pakistan, Bangladesh and Afghanistan” to live in India and be granted citizenship automatically without furnishing any documents.
He said these countries were part of India.
“As we all know that India was one of the largest countries in the world and there was no concept of Pakistan, Bangladesh and Afghanistan,” Justice Sen said in the order.
“They were in one country and was commanded by the Hindu Kingdom but thereafter the Mughal came to India and captured the different parts of India and started ruling the country and at that point of time many conversions took place by force,” added Justice Sen.
Justice Sen further said he is not against the "law-abiding Muslim brothers and sisters" who have been living in India for generations.
However, he said, the government should make “a uniform law” for all Indian citizens and anybody opposing Indian laws and Constitution cannot be considered as Indian citizens.
“We must remember that first, we are Indians, then good human beings and thereafter comes the community we belong.”
Justice Sen's order has, however, not gone down well with many calling his observations "shocking" and "disturbing".
And some have demanded a probe into the matter.
