Broadcaster Neil Mitchell says he has been subpoenaed to hand over an interview he conducted with a woman who alleges she was raped by AFL player Stephen Milne.
Milne, of Cheltenham, is due in court on Friday for a committal mention hearing over four charges of rape dating back to 2004.
Mr Mitchell said Milne's lawyers had requested the tape and any notes recorded by him be handed over.
He said he recorded the interview in 2004 but legal issues and an agreement made with the woman's family prevented him from airing it.
"The lawyers of Stephen Milne have issued 3AW, and me, with a subpoena demanding that I present to them the tape of this interview and other documents I've kept on the case that includes my notes, copies of police records, emails and things like that," Mr Mitchell said on his Fairfax Radio show on Friday.

Milne is alleged to have raped a woman four times at a Highett home on March 15 in 2004.
He was charged on June 18 this year after a police review found the initial investigation was inadequate.
Mr Mitchell said he would not air the interview unless the family of the woman approved or unless she spoke to another media outlet.
He said he would fight the subpoena.
"We will argue in court, we will fight this, we will do everything we can (to not hand it over)," he said.
Mr Mitchell said he had personally explained to the family of the young woman that if ordered by court to hand over the tape of the interview then he has no option but to comply.
