ACCC says LG misled Aussies over TV rights

The ACCC says LG made false or misleading representations when it told buyers of its TVs they had no rights once the manufacturer's warranty had expired.

The consumer watchdog is taking LG Electronics to the Federal Court for the second time in a decade, this time for misleading Australians over their rights over faulty TVs.

The Australian Competition and Consumer Commission says the South Korean firm made false or misleading representations when it told customers they had no rights once the manufacturer's warranty had expired.

The ACCC said LG, which in 2006 was found in the Federal Court to have engaged in similar behaviour related to its mobile phones, told some customers they were liable for the cost of repairs, claimed any help it gave was only a goodwill gesture, and insisted on repairing rather than replacing faulty TVs.

"Consumers will often still be entitled under the consumer guarantee to a repair, refund or replacement after the manufacturers warranty ends," ACCC chairman Rod Sims said.

"The Australian Parliament has conferred these important rights on consumers, and these rights should not be undermined by misrepresentations."

The matter is listed for a case management conference in the Federal Court in Melbourne on February 5.
