Robert Xie vowed to continue fighting for his innocence as he arrived home from jail after four years, seven months and five days behind bars without conviction.

The man accused of murdering five members of the Lin family was released from Silverwater jail on Friday afternoon after being granted bail in the Supreme Court on Tuesday.

He was given bail after the jury in his third trial failed to reach a verdict last week.

"I'm grateful to be home," Xie told reporters outside his home in Sydney's northwest after his wife picked him up from jail.

"I will continue to fight for my innocence," he said.

Xie will spend his first night out of jail under 17 strict bail conditions.

The 51-year-old must wear an electronic monitoring device and will only be allowed to leave the North Epping home to attend medical and legal appointments after giving police 24 hours' written notice.

Xie has also put up his house - valued at up to $1.5 million - as surety and offered a $100,000 cash bond.

He will remain on bail while he awaits a retrial next year.
