A man who took part in the rape of an unconscious teenager at an Australia Day party in Brisbane has been given a suspended 18-month sentence.
Frazer John Eaton stood still as the sentence was handed down at the Brisbane District Court on Thursday morning.
The 23-year-old and three friends attacked the 18-year-old victim while he was drunk and passed out at party in 2015, with Eaton holding the young man's shoulders while a co-accused assaulted him with a beer bottle.
A third held his legs while a fourth filmed the incident.
During the brief sentencing, Chief Judge Kerry O'Brien said Eaton hadn't intended to cause harm to the victim and had not attacked him for sexual gratification.
"It is a most unusual offence," he said, describing it as "extremely foolish and juvenile behaviour carried out in the context of excessive drinking".
Eaton, he said, was not the principal offender, was genuinely remorseful, had minimal risks of reoffending and had been co-operative.
The video of the sexual assault was distributed on social media, but the victim did not learn what occurred until the next day when screenshots were sent to a group chat he was part of, the court heard.
He wasn't physically harmed and had played cricket with Eaton and his co-accused after being assaulted, the court heard.
Eaton, a former surf lifesaving representative and talented Australian rules footballer, pleaded guilty last Friday and was due to be sentenced that afternoon, but Chief Judge Kerry O'Brien said he wanted to give the matter "further thought" and adjourned his decision.
After the sentence, which has been suspended for two years, was handed down Eaton hugged supporters outside court.
