A Sydney man who allegedly infected another man with HIV will remain behind bars after he was arrested while trying to board a flight out of the city.
Martin Jaksic, 28, is accused of failing to tell a 33-year-old man he was HIV positive before they became sexually involved.
Surry Hills police began investigating the matter in 2012 after a 33-year-old told them he became infected with the virus.
On Sunday night, nearly four years after police began looking for Jaksic, Australian Federal Police officers arrested him at Sydney Airport.
The 28-year-old applied for a non-publication order on his name when he appeared via video link at Central Local Court on Monday to face one charge of recklessly inflicting grievous bodily harm.
There was a "real risk" the unique nature of the charges would potentially prejudice his chance of a fair trial, Jaksic's lawyer argued.
However, Magistrate Greg Grogan dismissed the claim and refused the Jaksic bail.
He is due to face court again on January 7.
