Bail test for alleged wife killer

The Sydney man charged with bludgeoning his wife to death on Halloween and lying about it faces a challenge to his bail.

Police have asked NSW prosecutors to appeal the release of Brian Bradbury, who has been accused of killing his wife on Halloween.

Bradbury, 58, was granted bail on Thursday in Parramatta Bail Court over the death of his wife Lynette Bradbury, 52, in their Oatlands home, in Sydney's northwest, on October 31, 2011.

A senior police source told AAP on Friday that homicide detectives had requested that the NSW Department of Public Prosecutions (DPP) consider appealing the magistrate's decision.

Magistrate Jennifer Betts told the court on Thursday that bail was granted to accused murderers only in exceptional circumstances but this appeared to be a strong circumstantial case.

In granting him bail she also acknowledged that Bradbury faced up to 18 months in custody before a trial.

Police allege Bradbury, a Westmead Hospital cleaner, likely had an argument with his wife about his gambling addiction when she arrived home from work on the afternoon of her death.

It is alleged Bradbury attacked her, bludgeoned her about the head with a 2kg dumbbell and duct taped her hands and ankles.

He went to work minutes later for his evening shift.

Upon returning that night, police say he staged a random home invasion and then alerted a neighbour.

Police also say the fact that a cup of Milo that Bradbury made his wife every day before setting off to work, found untouched in the kitchen, was evidence he bludgeoned her to death before he left the house.

They further allege it was odd that the victim was bound but nothing had been stolen.

His gambling addiction was straining their relationship, police allege, and Mrs Bradbury had confided in a friend that if she caught him gambling again she would leave him.

Comment is being sought from the DPP.
