The nation's only openly gay leader believes federal Labor MPs should be bound to a vote backing same-sex marriage, but only if the party is in government.

ACT Chief Minister Andrew Barr wants this week's ALP national conference to endorse a policy where a future Labor attorney-general introduces the necessary legislation and binds the caucus to a mandatory vote.

"My view is ultimately this is a human rights issue and should not be subject to a conscience vote," he told Sky News on Wednesday.
