The Sydney widow of slain former bikie boss Mahmoud "Mick" Hawi is no longer seeking to use the sperm extracted from his body the day after he was gunned down.
A urologist was authorised to perform a "posthumous sperm retrieval" when widow Carolina Gonzales made an urgent court application after Hawi was gunned down outside a Rockdale gym in Sydney's south on February 15.
No one has been arrested over the murder of the former Comancheros president.
The NSW Supreme Court application was made on the basis that Gonzales wanted to have a child from Hawi in the near future.
Justice Peter Johnson then ordered the sperm be extracted and stored at an IVF facility until he ruled on her application - listed for hearing on September 25 - to use the sperm.
But on Friday he was told Ms Gonzales didn't wish to continue proceedings for personal reasons.
"The court is asked to make orders which would bring the proceedings to an end with an associated order that the sample presently retained be destroyed," he said.
Justice Johnson noted the NSW attorney-general had become a party in the case for reasons including it "raised significant legal issues".
But he was told on Friday some of these issues are now being litigated in separate and unrelated proceedings before the court.
The judge dismissed the application, set aside the hearing date and ordered the sperm be destroyed as soon as practicable - but no later than August 3.
