The driver accused of murdering five people who died after they were struck by a car that ploughed through Bourke St mall could face more charges.

James 'Jimmy' Gargasoulas, 26, was charged with five counts of murder on Monday.

Police were forced to wait three days to charge him after they shot him in the arm on Friday as he allegedly ran down pedestrians in Bourke Street mall, killing five and injuring more than 30.

Shortly after doctors cleared him for interview on Monday, police slapped him with five murder charges and said more were pending.

He was taken to the Melbourne Magistrates' Court but was allowed to stay in the custody cells after the 26-year-old requested not to be brought into the dock.

Prosecutors have asked for longer than usual to prepare a brief of evidence against Gargasoulas due to Friday's "unprecedented events".

The case is due to return to court in August.

Gargasoulas was on bail when he allegedly deliberately ran down dozens of strangers in Melbourne's lunchtime crowds, killing Thalia Hakin, 10, three-month-old Zachary Bryant, Jess Mudie, 22, Matthew Si, 33, and a 25-year-old man.
