The woman chosen to replace Stephen Conroy in the Senate has not been referred to commonwealth prosecutors for possible breaches of the criminal code.
The royal commission into trade unions recommended the director of public prosecutions consider prosecuting Kimberley Kitching, a former Health Services Union official and ally of Opposition Leader Bill Shorten, for aiding and abetting other union officials.
But DPP Sarah McNaughton told a Senate estimates hearing on Tuesday she had "not received any brief in relation to that".
Ms McNaughton, who has declared a conflict because she was involved in the royal commission, confirmed eight referrals to the DPP from the inquiry had been completed.
