Home Affairs Minister Peter Dutton will miss at least a week of parliament after having surgery on an injured arm.

But Labor isn't holding back on him, pushing to have him referred to the High Court over questions about his eligibility to sit in parliament.

Mr Dutton revealed on Twitter he suffered the injury on Friday, had surgery on the weekend and will see an orthopaedic surgeon again this week.

"The (Attorney-General) will act for me during my absence and will continue progressing our important national security legislation," Mr Dutton tweeted on Monday.

Labor is pushing to refer Mr Dutton to the High Court over questions about his eligibility under Section 44 of the constitution, which bans people who profit from the commonwealth government.

The opposition argues Mr Dutton's interest in his family's childcare businesses breaches the constitution because they receive federal payments to pass onto parents.

Seven News now reports lawyers for a refugee whose visa has been revoked have asked for a stay in the case until Mr Dutton's eligibility is resolved.

The Home Affairs Minister has cancelled 1600 visas since the last election, which would be in jeopardy if he was found ineligible to sit.

"Mr Dutton needs to resolve the cloud. Now, he'll probably get up and yell and you know, carry on and attack Labor," Labor leader Bill Shorten told ABC radio on Monday.

"It's the lawyers of the people that the authorities are trying to take action on who are using the cloud over Mr Dutton's eligibility to save their clients."
