A Victorian road-rager who caused a three-vehicle crash that killed a little boy has lost an appeal against his conviction.
Former banker Ian Bouch failed in a bid to overturn his conviction for the 2014 crash at Truganina, which killed 10-year-old Yahye Hashi at Truganina in 2014 and left a seven-year-old girl seriously injured.
Victoria's appeals court on Thursday dismissed his appeal after finding no substantial miscarriage of justice had occurred.
Bouch was jailed last year for eight-and-a-half years, with a minimum of six years.
He was driving behind a Toyota wagon with four children on board when he began tailgating the vehicle, flashing his lights and blowing his horn.
At the same time, he was aware a tipper truck was travelling behind his vehicle and the Toyota.
He overtook the Toyota on the passenger side and sped past, then cut back in front it before suddenly braking without reason, causing his car to stop.
The Toyota driver was able to stop in time, but the truck travelling behind her was not.
It hit the Toyota, in turn pushing it into the back of Bouch's car.
One of the children on board, Yahye Hashi, was flown to hospital and died from massive head injuries after spending five days in intensive care.
Another child, Yasmin Hashi, 7, suffered a broken arm.
The next day, Bouch lied to police about the circumstances of the crash.
The Court of Appeal agreed while misdirections to the jury had occurred during his trial, there was no miscarriage of justice.
