Govt pushes through native title bill

A bill to reverse the effect of a recent Federal Court decision regarding native title has been introduced in parliament.

The federal government is pushing through urgent new laws in a bid to reverse a significant Federal Court ruling relating to native title claims.

Justice Minister Michael Keenan on Wednesday introduced to parliament a bill to reinstate a 2010 decision that was effectively overruled a fortnight ago.

The February 2 ruling by the full court means a single member of a claimant group can prevent an Indigenous land use agreement from being registered if they withhold their consent.

Mr Keenan said the proposed legislation would re-establish the status quo so agreements were authorised based on the claimant group's broader will.

The bill will apply retrospectively.

"These measures will protect the benefits and interests that have been granted on both sides and provide certainty to parties who have commenced or are proposing negotiations for an indigenous land use agreement," he told MPs.
