Jim Molan to take Nash senate seat

Retired major general Jim Molan has been cleared to replace Fiona Nash in the Senate after the High Court declared he was duly elected.

Justice Stephen Gageler on Friday said there should be no "lingering uncertainty" about the matter after former Nationals senator Ms Nash was disqualified during the dual citizenship saga.

Mr Molan, a Liberal candidate who'll represent NSW, received praise from Prime Minister Malcolm Turnbull following the decision, highlighting his "vast military experience, courage and wisdom".

The Senate is scheduled to sit on February 5.

The court was not asked to rule on the question of what place Mr Molan would take on the list of 12 NSW senators which determines whether they have three or six-year terms.
