Underworld matriarch Judy Moran will lodge an appeal against her murder conviction, citing fresh evidence in the case.

The 71-year-old was sentenced to 26 years' jail in 2011 for arranging the killing of her brother-in-law Des "Tuppence" Moran.

Her lawyer George Defteros on Wednesday said documents would be lodged with the Victorian Court of Appeal when grounds are finalised.

"We'll be seeking to lodge on the basis of fresh evidence," he told AAP.

Wheelchair-bound Moran is currently behind bars at Melbourne's Dame Phyllis Frost Centre.

In May she lost a bid in the Supreme Court to be immediately returned to the open-style Margaret units at the prison.

Her lawyers at the time said management had moved her to a higher security unit, with fewer facilities, because she had witnessed a violent altercation between two other prisoners.

But a letter from the prison revealed allegations Moran was "exercising an unhealthy level of influence" over her fellow inmates.

Prosecutors in 2012 lost a bid to confiscate proceeds from the sale of Moran's million-dollar Ascot Vale property.

A jury found Moran guilty of plotting the June 2009 murder of Mr Moran, who was shot seven times by hitman Geoffrey Armour as he paid for his lunch at an Ascot Vale cafe.

Armour pleaded guilty and received the same sentence as Moran, which included a non-parole period of 21 years.
