A man has been charged with murder after he allegedly detained a man caught breaking into his NSW home, who later died.

The 33-year-old man is expected to face Newcastle Bail Court on Monday after the incident in Cleary Street, Hamilton on Saturday morning.

The man allegedly detained a 34-year-old man caught committing a break, enter and steal offence in the man's home, police said in a statement on Saturday night.

The older man was taken to John Hunter Hospital with critical injuries, and the other man was initially charged with recklessly inflicting grievous bodily harm.

The charge was upgraded on Sunday afternoon after the 34-year-old's life support was turned off.
