NSW gay nurse says cop discriminatory

When a Sydney nurse went to police with allegations his former boyfriend had maliciously infected him with HIV, he says the response left him humiliated.

When a Sydney nurse told police his former boyfriend had maliciously infected him with HIV, one allegedly asked: "Isn't this part and parcel of being gay".

The 47-year-old nurse, who cannot be named, made the claim while he was being cross-examined on his police statements at the Downing Centre District Court on Thursday.

He said he had not mentioned in his first statement to police that he and his former boyfriend, referred to as MA, had unprotected sex the first time they met in January 2004.

The nurse said he "just wanted to get out of there (the station)".

The NSW police officer whom he was giving the statement to was being transferred the next day and the cop "didn't want to be there".

"He asked me: `Isn't this part and parcel of being gay," the nurse said.

"I felt humiliated and ashamed."

MA, 65, has pleaded not guilty to one count of maliciously causing a person to contract a grievous bodily disease and one count of maliciously inflicting grievous bodily harm.

The court has previously heard the pair had met in person in January 2004 after connecting on the website Gaydar.

The nurse told the court they had unprotected sex during their initial encounter even though he told police it was days later.

The nurse and MA went on a holiday to Vietnam months after meeting, the court has previously heard.

During the trip, the nurse said he received a call from MA's ex-boyfriend asking whether the 65-year-old had informed him that he had HIV.

In August 2004, the nurse was diagnosed with HIV.

Despite the positive result, the pair's relationship continued until December 2006.

"I was afraid of being alone," the nurse said.

The trial before Judge Mark Marien continues.
