NSW land-clearing laws back to court

The NSW Nature Conservation Council is mounting a legal challenge to land-clearing codes introduced by the NSW government in March.

The NSW government is facing a fresh legal challenge to controversial land-clearing laws that have already been shot down once in the courts.

The new laws would allow landowners to clear sections of native bushland on their property without prior environmental assessment.

An attempt by the government to push the laws through in 2017 failed after the Land and Environment Court ruled the codes invalid when it was revealed proper process was not followed during their creation.

On Wednesday the Nature Conservation Council of NSW confirmed it had mounted a legal challenge to the government's second attempt at introducing the laws.

The NCC NSW claims documents obtained through Freedom of Information reveal Environment Minister Gabrielle Upton rushed the legislation the second time around and failed to give proper consideration to the laws.

The council says Ms Upton did not have enough time or materials to allow her to make a fully informed decision on the outcome of the laws.

The legal challenge was lodged with the Land and Environment Court earlier this month, with a court date set down for July.

Premier Gladys Berjeiklian said she was confident Ms Upton had followed due process in drafting the legislation, adding the NCC was within its rights to challenge the laws.

"We're a democracy, people have their rights and they're free to exercise them and I have no issue with that," the premier told reporters in Sydney on Wednesday.
