Penfolds maker wins Chinese trademark case

The maker of Penfolds wine has won an important legal case in China, earning the right to use the Chinese version of the trademark.

The maker of Penfolds wine has won a legal case in China affirming its right to use and market the "Ben Fu" trademark, which in Chinese characters translates to Penfolds.

Treasury Wine Estates says the Beijing High People's Court has found a Chinese individual who registered the Ben Fu trademark in 2009 had failed to show any genuine use for the trademark for wine or related activities.

The company can now claim its right to ownership of the Ben Fu trademark registration and is free to use the trademark across China.

Treasury Wine's managing director for Asia and Europe, Robert Foye, said protecting the integrity of the company's historic wine brands against piracy was critical.

"Ben Fu is the most widely recognised wine brand in China," Mr Foye said.

"We have never wavered in our commitment to defend our position as the rightful owner of the Ben Fu trademark in China, and we are absolutely thrilled with this decision."
