Opposition Leader Bill Shorten wants Prime Minister Tony Abbott to explain the circumstances in which he thinks torture is acceptable.
While in Sri Lanka for the Commonwealth Heads of Government Meeting, Mr Abbott said his government deplores the use of torture but accepts that difficult things sometimes happen in difficult circumstances.
"I don't think he should be fudging about torture," Mr Shorten told Sky News on Monday.
"Mr Abbott is going to have to explain what are the difficult circumstances in which torture is appropriate."
