Federal police are not investigating the alleged misuse of MPs entitlements despite numerous complaints from Labor MP Rob Mitchell and the public.
Mr Mitchell wrote to the Australian Federal Police asking them to investigate Prime Minister Tony Abbott and Attorney-General George Brandis over a swag of travel claims made by the pair.
The Victorian MP said Senator Brandis, as shadow attorney-general in the previous parliament, had set a precedent by referring a number of matters relating to MPs directly to the AFP.
"I have asked for an investigation into the use of the travel claims by George Brandis and Tony Abbott," Mr Mitchell told AAP on Thursday.
The matters included Mr Abbott's claims of entitlements regarding the promotion of his book Battlelines, the attendance at the weddings of Peter Slipper and Sophie Mirabella and at six sporting events.

Mr Abbott has paid back a number of claims, but defended others as legitimate.
Mr Mitchell asked for an investigation also into Senator Brandis' $2200 in claims for expenses in attending two weddings, which he has since repaid.
"I think the public at large are not over-impressed by what is going on," Mr Mitchell said.
"We are not talking about making a mistake on a form ... this has been consistent over a fair period of time."
The AFP later confirmed receiving two letters from Mr Mitchell and a number of complaints from members of the public about the alleged misuse of entitlements by members of parliament.
"The Department of Finance is responsible for the administration of entitlements for members of the Australian Parliament," the AFP said in a statement.
It said it was not investigating the allegations, but had forwarded them to the finance department.
