Australian Federal Police are investigating a range of potential charges against the crew of the fatal Christmas Island boat tragedy.

An AFP spokesman says officers have interviewed the three Indonesian nationals, and will make a determination on possible charges in due course.

Prime Minister Julia Gillard says the final death toll from the accident is likely to rise to about 48, with latest estimates suggesting 90 people were on board Siev 221 when it crashed last Wednesday.

Ms Gillard says she has no plans to lift the level of refugees accepted by Australia but will focus instead on smashing the smuggling business with the regional protection framework and proposed offshore processing centre.
