After nearly five years behind bars, Robert Xie has spent his first night back in his Sydney home.

Xie, who is accused of murdering five members of his extended family, vowed to continue fighting for his innocence after he was released on bail on Friday afternoon.

"I'm grateful to be home," Xie told reporters outside his home in Sydney's northwest on Friday.

"I will continue to fight for my innocence," he said.

Xie was granted bail in the Supreme Court on Tuesday after the jury in his third trial failed to reach a verdict last week.

The 51-year-old is under 17 strict bail conditions including that he wear a GPS tracking device.

He will only be allowed to leave his home to attend medical and legal appointments, and even then he must give police 24 hours' written notice.

Xie will remain on bail while he awaits a retrial next year.
