Sydney 'Uber' driver accused of rape

A man claiming to be an Uber driver allegedly raped a Sydney woman in the back of a car. He told a Sydney court the sex was consensual.

A man claiming to be an Uber driver who allegedly raped a British tourist as she slept in the back of his car stopped to buy condoms before the attack, a court has heard.

Muhammad Naveed, who turns 40 on Friday, is accused of attacking the 22-year-old woman in the early hours of Sunday in Sydney's eastern suburbs.

Documents tendered to Burwood Local Court on Thursday claimed the victim was "well intoxicated" and believed Naveed was a taxi driver when she accepted a lift home after a night out.

During the journey, CCTV captured him visiting a BP service station to buy condoms, before he later pulled over and allegedly sexually assaulted the woman while she was sleeping.

The 22-year-old awoke to the driver having sex with her, court documents state.

Naveed, who is a permanent resident in Australia, claims the sex was consensual after he offered the woman a lift home during a break from working as an Uber driver, court documents said.

Naveed, who is charged with one count of sexual intercourse without consent, will be granted bail if he is able to raise $5,000 and must hand over his Pakistani passport.

He is next due to appear at the Downing Centre Court in December.
