Mr Thomson's comments come as the ACTU executive meets today at 1pm (AEST) in Melbourne to consider suspending the HSU from its ranks in a bid to show the labour movement won't put up with corruption.
Mr Thomson wouldn't comment on the expulsion issue, saying he hasn't worked for the HSU in more than five years and it's a matter for them and the ACTU to work out.
But he says he's encouraged that Commonwealth DPP Chris Craigie has raised doubts over whether any criminal charges relating to the case will go ahead.
