Bernard Tomic's lawyer says an investigation he conducted revealed Miami police allegations against the Australian tennis player don't hold up.

Australia's top-ranked tennis player Bernard Tomic should not have been arrested in Miami and is confident of "a favourable resolution" soon in court, his US lawyer says.

Tomic's early morning arrest in a penthouse suite at the Miami Beach W Hotel in July created world headlines.

The 22-year-old, ranked 21st on the ATP World Tour, was charged with resisting a police officer without violence and trespassing after allegedly playing loud music, pointing his finger aggressively at hotel security officers and dismissing police requests to leave the penthouse.

Tomic's Miami-based lawyer Chad Piotrowski said on Tuesday he has conducted a thorough investigation of the incident and has been working closely with the prosecutor assigned to the case.

"Mr Tomic is innocent," Mr Piotrowski told AAP.

"Through speaking to witnesses on scene that night and obtaining new evidence via subpoena from the W Hotel, I was able to determine that things didn't necessarily happen the way they were reported by the Miami Beach Police Department.

"Mr Tomic should've never been arrested.

"I've been working closely with the prosecutor assigned to his case and I'm confident that we'll have a favourable resolution soon."

A hearing has been scheduled for October 8 before Judge Luise Krieger-Martin in a court in Miami's Richard E Gerstein Justice Building, although Tomic is not required to appear.
